Terms of Use

1. Agreement

These terms are an agreement between you and TROODON YAZILIM TEKNOLOJI REKLAM HIZMETLERI SANAYI VE TICARET LTD. ŞTİ. (“Troodon Studio”, “we”, “us”) about your use of the iFax mobile app and related websites (the “Service”). By using the Service you accept these terms and our Privacy Policy. If you don’t agree, please don’t use the Service.

2. The Service

iFax lets you send documents, photos and scans as faxes from your phone and, with a subscription, receive faxes on a fax number assigned to you. Faxes travel over third-party phone and fax networks.

3. Eligibility

You must be at least 13 years old, or 16 in the EEA and UK, and able to enter into this agreement. If you use the Service for an organisation, you confirm you are allowed to accept these terms on its behalf.

4. Acceptable use

You are responsible for what you fax and who you fax it to. You agree not to:

• send unsolicited advertising, “junk faxes” or bulk fax campaigns;
• send content that is illegal, fraudulent, threatening, harassing or that infringes others’ rights;
• break laws that apply to faxing, such as the U.S. Telephone Consumer Protection Act;
• disrupt, overload, reverse engineer or gain unauthorised access to the Service;
• resell the Service or use it to build a competing product.

To prevent abuse we may apply reasonable limits, block faxes to certain numbers, and suspend accounts that break these rules.

5. Your content

You keep all rights to the documents you send and receive. You give us permission to store, convert and transmit them only as needed to provide the Service. You confirm you have the right to send them.

6. Fax numbers

A fax number is assigned to you while your subscription is active. We, or our network provider, own the number. You can’t transfer it, and we may change it if a carrier or the law requires. When your subscription ends or you delete your account, the number is released and may later be given to someone else.

7. Subscriptions and payment

• Sending faxes and getting a fax number require a paid subscription. Plans are billed weekly, monthly or yearly through your Apple ID at the price shown before you buy.
• Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. Your account is charged within 24 hours before renewal.
• You can manage or cancel your subscription any time in your Apple ID settings. Canceling stops the next renewal. You keep access until the current period ends.
• Deleting the app or your account does not cancel a subscription. If prices change, the new price applies from your next renewal and Apple will tell you first.
• Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com.
• We may offer a free test fax of a sample page. We can change or end this offer at any time.

8. Delivery

We work to deliver every fax, but delivery depends on the receiving machine, phone lines and other networks we don’t control. A fax may be delayed or fail, and we can’t guarantee delivery or delivery times. Please don’t rely on the Service alone for time-critical or emergency communications.

9. Our rights

The Service, including its software, design and brand, belongs to us and our licensors. We give you a personal, non-exclusive, non-transferable and revocable licence to use the app on devices you own or control, under these terms and the App Store’s usage rules.

10. Third-party services

The Service relies on third parties such as Apple and fax network providers, and may link to other sites. We are not responsible for their services or content.

11. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent allowed by law, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise that the Service will be uninterrupted or error-free.

12. Limitation of liability

To the fullest extent allowed by law, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, data or business opportunities. This includes losses caused by a fax that was delayed or not delivered. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or USD 100 if that is greater. Nothing in these terms limits liability that cannot be limited by law.

13. Indemnity

You agree to compensate us for claims, losses and costs caused by your content or your breach of these terms, including claims about faxes you sent.

14. Ending the agreement

You can stop using the Service and delete your account at any time in the app. We may suspend or end your access if you seriously or repeatedly break these terms, or if the law requires it. Sections that by their nature should continue, such as 11 to 13, continue after the agreement ends.

15. Apple

These terms are between you and us, not Apple. Apple is not responsible for the app, its maintenance or support, or any claims about it, including product liability, legal compliance or intellectual property claims. If the app fails to meet a warranty, you may tell Apple and Apple will refund the purchase price, if any. Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

16. Consumer rights

If you are a consumer, you keep any rights that the law of your country of residence gives you and that cannot be waived by contract. Nothing in these terms affects those rights.

17. Changes

We may update these terms. We will change the date at the top, and tell you in the app if the changes are significant. If you keep using the Service after a change, you accept the new terms.

18. Governing law

These terms are governed by the laws of the Republic of Türkiye. The courts of Türkiye have jurisdiction, unless consumer protection law gives you the right to bring a claim in the country where you live.
